WHAT DOES THIS PRIVACY POLICY COVER?

Alduna (“we”, “us”, “our”) is dedicated to protecting our users (“you”, “your”) personal information and informing you about how we use your information. This privacy policy applies to your use of the Alduna services including our website www.alduna.org, social media, apps and partner platforms (collectively “Platform”). This Privacy Policy should be read in conjunction with the Terms & Conditions of Alduna. All capitalized proper nouns will have the same definitions and meanings as defined by the Terms & Conditions. This Privacy Policy is wholly integrated into the Terms & Conditions. Please review this Privacy Policy periodically as we may revise it from time to time without notice. If you do not agree with or accept our Privacy Policy in its entirety, you must not access or use our Platform.

We only collect Personal Information through our Services from a child under 13 where that student’s school, district, and/or teacher has agreed (via the terms described in the Terms of Use) to obtain parental consent for that child to use our Services and disclose Personal Information to us or where the parent or legal guardian of a child has signed up or been invited to sign up or approve the child to use our Services. If you are a child under 13, please do not send any Personal Information about yourself to us if your school, district, and/or teacher has not obtained this prior consent from your parent or guardian or if your parent or guardian has not signed you up and given their approval for you to use our Services, and please do not send any Personal Information other than what we request from you in connection with our Services. If we learn we have collected Personal Information from a child under 13 without parental consent being obtained by his or her parent, guardian, school, district, and/or teacher, or if we learn a child under 13 has provided us personal information beyond what we request from him or her, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information in violation of this paragraph, please contact us at privacy@alduna.org.

When we use the term “Personal Information” in this Privacy Policy, we are referring to personally identifiable information of individual, non-children (i.e., adult) registrants of our Services. References to “Children’s Personal Information” only apply to personally identifiable information collected from users who have registered for our Services as minor students (i.e., students under the age of 13). General references to “information” apply to all users.

We gather various types of Personal Information and Children’s Personal Information from our users, as explained more fully below. We may use this Personal Information and Children’s Personal Information to personalize and improve our services, to allow our users to set up a user account and profile, to contact users, to fulfill your requests for certain products and services, to analyze how users utilize our Services, and as otherwise set forth in this Privacy Policy. We may share certain types of Personal Information and Children’s Personal Information with third parties, as described below.

As Alduna respects your privacy rights, we adhere to the Safe Harbor Principles that were established by the U.S Department of Commerce to help safeguard personal data online. Additionally, we intend to comply with all Swiss laws relating to online privacy and the EU Data Protection Directive (94/56/EC). WHAT TYPES OF INFORMATION DO WE COLLECT?

At Alduna, we collect personally identifiable information (“PII”) and non-personally identifiable (“Non-PII”) information from you. PII is information that can be used to identify you personally. Non-PII is information that cannot be used individually to identify you but must be combined with other information to identify you personally. Generally PII may be submitted in the following manner: 1) account registration, 2) message boards, 3) contest registration, 4) consumer complaint, 5) surveys, 6) customer service, 7) newsletter, 8) the purchase of goods or services.

WHAT PII IS COLLECTED?

In addition to the PII collected, we may collect non-PII. In order to register at Alduna you will be asked to submit other non-personal information such as your gender, location, teaching experience and others. In addition, your web browser or client software may transmit certain information about your computer and site usage, including but not limited to your IP address, zip code, gender, browsing history, search history, and registration history, interactions with the Platform, location, referring URL, browser, operating system, data usage, data transferred, and Internet Service Provider.

Alduna may use this information to generate statistics about our user community and provide such information to our advertisers. Alduna may also use this information for security, system integrity or enforcement purposes.

HOW DO WE USE YOUR PERSONAL INFORMATION?

The personal information you provide Alduna will allow us to fulfill your customer services and requests; alert you of new products or services, features, or enhancements; handle/route your customer service or technical support questions or issues; assist us in providing our services to you; to share with third parties that you have indicated an interest in; and/or notify you of contests, promotions, or special events and offers.

Alduna may enhance or merge the personal information collected with data from third parties. We may use your personal information for internal/external marketing, profiling, or demographic purposes, so we can adapt our products and services to better suit your needs. We do this to better understand and serve the community. Please be advised that personal information submitted by individuals acting solely in a business capacity (e.g., personal information contained in job applicant’s resume) is not subject to the uses set forth above or to any other practices stated in this Privacy Policy.

WITH WHOM MAY YOUR PERSONAL INFORMATION BE SHARED?

Alduna may need to disclose your PII to third party vendors to fulfill product orders or prizes, to process mailings, or to process, analyze, and/or store data. Additionally, we may share your PII with third parties that we believe that you might be interest in. It is therefore necessary that you grant the third parties we may use in the course of our business the same rights that you afford us under this Privacy Policy.

For this reason, you hereby agree that for every authorization which you grant to us in this Privacy Policy, you also grant to any third party that we may hire, contract, or otherwise retain our Services of for the purpose of operating, maintaining, repairing, or otherwise improving or preserving our Platform or its underlying files or systems. We will attempt to ensure that these entities do not use your PII for any other purpose, and that they have agreed to maintain the confidentiality, security, and integrity of the personal information they obtain from us.

We reserve the right to disclose your PII if we believe that you are violating the Terms & Conditions, or if we believe that you may be causing injury to or interference (intentionally or unintentionally) with Alduna rights or property, other users of the Alduna site, or anyone else who could be harmed by your activities. Alduna may also have message boards and/or chat areas, where users can exchange ideas and communicate with one another. When posting to a message board or chat area, please be aware that the information is being made publicly available on-line and the user does so at his or her own risk.

In certain situations, businesses or third party websites we are affiliated with may sell items or provide services to you through our Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. If you are a child user, we will not share your Children’s Personal Information in connection with any commercial third party transaction or service. For adult users, we have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, our agents do not have any right to use the Personal Information or Children’s Personal Information we share with them beyond what is necessary to assist us. We also take steps to ensure that they agree to protect the Personal Information or Children’s Personal Information shared with them. 

We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information and Children’s Personal Information would be one of the assets transferred to or acquired by a third party, if permitted by applicable law.

We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Alduna, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Except as set forth above, you will be notified when your Personal Information or Children’s Personal Information may be shared with third parties in personally identifiable form, and will be able to prevent the sharing of this information. In the case of Children’s Personal Information, we will first obtain the prior verifiable consent of a parent or legal guardian, or require that the teacher/school do so.

WHEN WILL MY INFORMATION BE SHARED WITH LAW ENFORCEMENT?

We reserve the right to disclose your PII to authorities if compelled to by a court order. Additionally, you agree that we may disclose your information if we reasonably believe that you have violated Swiss laws or the terms of our Terms & Conditions or Privacy Policy or if we believe that a third party is at risk of bodily harm. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either.

We may also proactively report you and release your information without receiving any request to third parties where we believe that it is proper to do so for legal reasons, where your actions violate any law of Switzerland or any other country having jurisdiction over us, our Platform, or our Terms & Conditions. You release us from any damages that may arise from or relate to the release of your information to a request from law enforcement agencies or private litigants. We may release your information under the conditions listed in this paragraph whether it is to individuals or entities and to any state or federal authorities, as required.

WHAT CHOICES DO I HAVE REGARDING THE COLLECTION, USE, AND DISTRIBUTION OF MY PERSONAL INFORMATION?

Alduna allows you to control the way that we use PII that we might obtain. At the time you provide personal information, Alduna may give you the option of declining any future offers or information about new products, promotions, or services. In addition, many of the „mailings“ Alduna may send you, such as newsletters, have procedures within them to cancel the receipt of any future mailings.

We currently do not offer functionality for you to opt out through “do not track” listings. If you wish to opt out of certain communications or information collection, please contact us at privacy@alduna.org.

WHAT ARE COOKIES AND HOW DO YOU USE THEM?

Cookies are a feature of your Web browser that allows Web sites to transfer bits of information to your computer for record-keeping purposes. A cookie stored on your computer can be used to „remember“ things like your password, your preferences, or that you have already registered. This allows us to speed up your future activities, saving the time you would normally spend entering information such as your password or registration.

In addition, Alduna may use cookies to retrieve user information for promotional, marketing, or security purposes. If you decide to disable cookies from loading on your Web browser portions of the Platform may not be able to function properly. Please be aware that some cookies loaded onto our Platform may be accessible by third parties.

Our Platform uses cookies from Google to deliver its services to you and to personalize ads and analyze traffic. Information about your use of this Platform is shared with Google. WHAT DO I DO IF I WANT TO CORRECT OR DELETE MY PERSONAL INFORMATION?

If for any reason you are concerned with the way we are using your PII, or would like to correct or request that we delete such personal information, please contact us by e-mailing us privacy@alduna.org. Please note that the deletion of your data may lead to the termination of your account and applicable services. After you have deleted your PII, please be aware that we may keep inaccessible copies of your information for a reasonable period of time for legal purposes.

If you would like to request that Children’s Personal Information regarding your child be updated or deleted (or, if you are a teacher, a child that is in your class) by our Services, or if you wish to request that we discontinue the further collection nor use of Children’s Personal Information, please contact us at privacy@alduna.org. A minor student’s participation in our Services, and the ability of a minor student to access our Services, will not be conditioned on that student providing more Children’s Personal Information than is reasonably necessary for that participation or access. We will respond to a request made pursuant to this section within 30 days of our receipt of such request.

To request removal of your Personal Information or Children’s Personal Information from our public forums, contact us at privacy@alduna.org. In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to do so and why.

HOW SECURE IS MY PERSONAL INFORMATION?

Alduna has taken steps to assure that all information collected will remain secure and in its original form, i.e. free from any alteration. As such, access to all personal information is strictly controlled. When credit card information is transmitted, for example, we use industry standard, SSL (secure sockets layer) encryption. In addition, we will take reasonable steps to assure that third parties to whom we transfer any data will provide sufficient protection of personal information. Though we attempt to keep your information safe and secure, you must understand that electronic transmission of information over the internet is never 100% secure and thus we cannot guarantee the absolute safety and security of any information provided.

WHERE IS MY INFORMATION STORED?

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. PII and Non-PII that is submitted to Alduna will be collected, processed, stored, disclosed and disposed of in accordance with applicable Swiss law and this policy.

If you are a non-Swiss member, you acknowledge and agree that Alduna may collect and use your Information and disclose it to other entities outside your resident jurisdiction. In addition, such information may be stored on servers located outside your resident jurisdiction. Swiss law may not provide the degree of protection for information that is available in other countries.

MERGERS AND ACQUISITIONS

As with any business, your PII is also an asset of Alduna and will become part of our normal business records. As such, we may also disclose your PII to a third party if we decide to sell any portion of our business to a third party. Similarly, in the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your personal information may be transferred to Alduna successor or assign.

HOW ARE CHANGES MADE?

Like our Terms & Conditions, we may amend this Privacy Policy from time to time. When we amend this Privacy Policy, we will modify the date listed on this Privacy Policy or we may contact you if such changes are material. You must agree to the amendments as a condition of your continued use of our Platform. If you do not agree, you must immediately cease using our Platform and notify us of your refusal to agree by e-mailing us at privacy@alduna.org.
